Civil Litigation and Appeals

I practice in New Mexico state and federal district courts, primarily representing defendants in civil cases.  I have also practiced in the New Mexico Court of Appeals, New Mexico Supreme Court, and the United States Court of Appeals for the Tenth Circuit.

Creditor Representation

Negotiation, Foreclosure, and Bankruptcy

I have represented creditors seeking to enforce their contractual rights through negotiation and litigation, and I have also represented secured creditors in bankruptcy proceedings.

Post-Judgment Investigation and Enforcement

I have used post-judgment discovery and supporting research to identify and pursue judgment-debtor assets to satisfy pre-existing judgments.  I have also initiated fraudulent-transfer actions to recover improperly-transferred assets.

Lease and Contract Enforcement

If you are a party to a lease or other contract, and you believe that another party to that agreement has failed to comply with its obligations to you, it is important to take measured steps to enforce your rights.  Going directly to court is often not the best option, but informal communications such as e-mails, text messages, and phone calls can sometimes have unintended negative consequences.  I can carefully analyze your lease or other contract together with any relevant facts, prepare a formal written communication (demand letter) for your approval, and attempt to have your concerns resolved without the need for litigation—all while laying the groundwork for legal action if it becomes necessary.


Briefing Support

I offer analytical and drafting support for other attorneys.  I have particular experience in evaluating and preparing a full range of threshold motions (such as motions to dismiss) as well as motions and responses regarding summary judgment, discovery disputes, and other pretrial matters.

Utility Representation

Pole Attachments

Under federal law and applicable FCC regulations, certain types of telephone, cable TV, and Internet service providers have the right to place wire-line and wireless attachments on utility-owned distribution poles.  I have represented electric utilities in analyzing their legal rights and obligations relating to pole attachments and dealings with potential attachers.

NERC Compliance

I have assisted electric utilities in evaluating their compliance with the Reliability Standards established by the North American Electric Reliability Corporation (NERC), including Reliability Standards relating to Critical Infrastructure Protection (CIP).
